Alternative Dispute Resolution (ADR), whereby disputing parties agree to refer an existing or future case to a third party, offers businesses an opportunity to manage any conflicts in an efficient and cost-effective manner. In addition the parties have a greater degree of control over the process and the outcome, both of which are usually confidential. Although various forms of ADR exist, Arbitration and Mediation are now widely recognised as the primary processes in use internationally and are firmly part of the civil justice systems of many countries, including the US, Canada and the UK.
